About the book

This collection of essays brings together a selection of the many papers delivered at a young researcher seminar held in Warsaw in July 2004 with the funding and support of the European Commission. The book is divided into three parts: 
· constitutionalisation and integration;
· differentiation in EU law and policy; 
· the policy tool of conditionality in the EU's external relations. 

Working within this framework, the contributions have been selected according to their relevance. The book provides a useful launchpad for further research and discussion on a twelve topics of central importance to the Constitution and enlargement, at a time when the Union continues to extend its borders while at the same deepening its integration efforts and seeking new means to do so. 

Under the heading of Constitutionalisation and Integration, the first four chapters consider the implications of formalising European constitutionalism through the Constitution for Europe, look at how the Constitution contributes to democracy, transparency and efficiency in the Union, explore the role of the national parliaments under the Constitution and, finally, examine the institutional changes and balance in the Union in an enlarged Union, including as a result of the Constitution's provisions.

The second part, dedicated to topics in differentiation in EU law and policy, focus on the areas of Economic and Monetary Union, the Common Agricultural Policy and EU counter-terrorism following enlargement as well as on the status of Turkish Cypriots in regard to EU citizenship. The third and final part of the book concentrates on the conditionality used by the Union in respect of countries waiting in the wings to join the Union, specifically concentrating on the issue of minority protection as well as the democratisation process in Turkey.

About the editors

Andrea Ott studied law at the University of Cologne. She worked at the Chair for International and European Law of the University of Greifswald where she obtained her PhD (which focused on the integration of GATT/WTO law into the EC legal order) in 1996. From 1998 until 2003 she worked as a senior research fellow in European Law and International Economic Law at the T.M.C. Asser Institute in the Hague, the Netherlands, and in 2002/2003 as a Jean Monnet Fellow at the European University Institute in Florence, Italy. She is now lecturer in European Union Law at the Universiteit Maastricht.

Kirstyn M. Inglis studied law at Dundee University in Scotland and enrolled as a solicitor with the Scots Law Society in 1990. Since her time at university she has concentrated on European law working first as a solicitor with city law firms in Brussels and London and then in specialist consultancies in Brussels, as a consultant to both private and public organisations on EU chemicals, agri-food and environment law. Since 1998 she has been with the European Institute as a legal researcher. Her main field of interest is EU eastwards enlargement with a focus on food and environmental law.
