Europese Rechtspraak – Algemeen Deel bevat de belangrijkste uitspraken van het Hof van Justitie van de Europese Unie over zowel het institutionele als het materiële Europese recht. Daarmee is de bundel in de eerste plaats bedoeld om te worden gebruikt in het hoger onderwijs (Bachelor of Master). Deze arrestenbundel volgt daarbij de structuur van het handboek Europees Recht - Algemeen Deel (vijfde druk). De samenhang tussen de bundel en dit handboek zit met name in de keuze van arresten: alle uitspraken in deze bundel zijn ook, thematisch en in dezelfde volgorde, gebruikt in Europees Recht - Algemeen Deel. Bovendien is, net als in het handboek, de interactie tussen het EU-recht en het Nederlandse recht een belangrijke pijler. Derhalve zijn ook uitspraken opgenomen van Nederlandse rechters waarin EU-recht een centrale rol speelt. Voor onderwijsdoeleinden, en voor groter leesgemak, zijn de opgenomen uitspraken bewerkt. Ze zijn voorzien van een korte inleidende tekst en zijn, waar mogelijk, ingekort. Van arresten van vóór de inwerkingtreding van het Verdrag van Lissabon (op 1 december 2009) zijn naast de oudere verdragsartikelen de huidige, corresponderende, artikelen uit het Verdrag betreffende de Europese Unie (VEU) of het Verdrag betreffende de Werking van de Europese Unie (VWEU) ingevoegd. Bij zeer oude arresten, die in hun originele versie geen nummering van rechtsoverwegingen hadden, is bovendien een eigen nummering toegevoegd. Tot slot bevat deze bundel een numeriek én een alfabetisch register van de behandelde uitspraken. De samenstellers van deze bundel, dr. R.H. van Ooik en dr. T.A.J.A. Vandamme, zijn werkzaam aan de Faculteit der Rechtsgeleerdheid, Universiteit van Amsterdam.

About the bookImproving the quality of environmental law is high on the agenda of both the European Union and its Member States. In the Netherlands, there has been a series of changes of law in order to simplify and improve the complex and fragmented system of environmental law. However, the improvement of sectoral legislation has not led to the desired result. The Dutch legislature now considers a fundamental reform of environmental law necessary. One of the main goals is to achieve a coherent approach towards the physical environment in policy, decision-making and regulations. The Environment and Planning Act brings together 26 acts and about 120 governmental decrees in the area of spatiality and planning, infrastructure, nature and water, in order to create a single act for the physical environment. This book focuses on one of the key instruments of environmental law, the environmental permit. The integration of sectoral environmental permit systems is a way to simplify and speed up decision-making procedures for the authorisation of activities affecting the physical environment. The goal is to introduce a fully integrated environmental permit system. This means not only procedural integration of sectoral permitting systems but also substantive integration of the various assessment criteria. This concept of integrated environmental permitting has generated a great deal of discussion in the Netherlands. In the context of this research, an overview will be given of developments in the field of integrated environmental permitting in Germany, Belgium and the Netherlands. Developments in EU environmental law and the new Dutch Environment and Planning Act are also included. About the author Hanna Tolsma is Assistant Professor (lecturer in public law and environmental law) at the Department of Constitutional Law, Administrative Law and Public Administration of the University of Groningen (h.d.tolsma@rug.nl). She received her PhD in 2008 on a thesis concerning legal aspects of the use of mediation by administrative authorities during the decision-making process. The book examines the legal guarantees provided under the European Union (EU) and the World Trade Organization (WTO) rules for the development of electricity transmission systems, either by constructing new transmission lines or by increasing transmission capacity. In the context of analysis of trade rules, the book makes the argument that, if long-distance trade in electricity remains a feasible option, the development of electricity transmission projects must be made subject to economic, technological and environmental criteria. It is dealt with in light of specific challenges of electricity trade related to its dependence on networks, storage and balancing. The book offers insights into the scope of the WTO and the EU related to access to and the development of cross-border electricity infrastructure development, connection and integration of abundant renewable energies into the electricity systems. It has criticized the EU’s regulations in terms of a lack of technological neutrality, as well as the WTO system in terms of lack of sector-tailored regulations that are necessary to achieve the objectives of the WTO to facilitate trade and transit. The regulatory environment for the development of cross-border electricity transmission projects has been examined based on identified obstacles from the analysis of the major multinational electricity systems in the world. AuthorDr Karolis Gudas holds PhD degree from the World Trade Institute, University of Bern. At present he is the General Counsel of the project of national significance to Lithuania – Vilnius CHP, a Lecturer in Energy Law at Vilnius University and Center Fellow at the Cambridge Centre for Environment, Energy and Natural Resource Governance, University of Cambridge. Karolis has significant experience in the energy sector having previously worked at the European Commission, as a consultant to the Iceland – UK electricity interconnector project and a legal counsel at the Baltic law firm Motieka & Audzevicius. About the book Since the 1970s, the Black Sea has been suffering a severe pollution from excessive input of nutrients and chemicals. To improve the situation, the Convention on the Protection of the Black Sea Against Pollution (Bucharest Convention) was signed in 1992 and the Black Sea Commission (BSC) was established. How has European Private Law responded to the property and mortgage markets crisis? And in what way is this reaction likely to model domestic systems? The financial and economic crisis that has marked the beginning of the century has had a devastating effect on the property and mortgage markets in many Member States of the European Union. Despite this, the European legislator took its time to respond. This book analyses the impact of the Mortgage Credit Directive (Directive 2014/17) in twelve different jurisdictions: Belgium, England, France, Germany, Greece, Ireland, Italy, Malta, The Netherlands, Poland, Portugal and Spain. The reports show how in some instances only certain products (such as foreign currency loans) or practices (irresponsible lending, homeownership promoting policies, the use of unfair terms) were factors that triggered the property crash; in other cases, the system completely failed to address an exceptional situation and, finally, in some instances, prudent lending explains why the market was virtually not hit at all. This book aims to find out whether the two goals of Directive 2014/17 (financial sector stability and enhanced consumer protection) can be achieved in light of its provisions and of the transposition carried out by the different Member States, and whether the changes it introduces have a significant impact in the jurisdictions here considered. Some systems are already showing signs of yet another property bubble. There is room for hope: perhaps we have learned from the past, perhaps the Directive is a step forward, but more importantly this book shows that we can learn from each other.

The Aarhus Convention entered into force more than 20 years ago. It lays down the pillars of environmental democracy, that is a governance systems where citizens and civil society organisations are fully involved in the decisions affecting the environment we all live in. On the one hand the Convention drew on the experience of those jurisdictions where environmental concerns run deeper. On the other hand, once enacted, it was expected to bring about important changes in those jurisdictions which were less sensible to these issues.
